1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the website located at localleverage.ai (the "Site") and the marketing services provided by Local Leverage AI ("Local Leverage AI," "we," "us," or "our"), including but not limited to the M.I.M.O.E. program and the Local Dominator program (collectively, the "Services"). By accessing the Site, purchasing, or using any Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
2. Services
Local Leverage AI provides digital marketing services for local businesses, which may include paid advertising management, website design and hosting, AI-powered communication and appointment booking tools, search engine optimization, Google Business Profile optimization, review and reputation management, and related consulting. The specific scope of Services you receive is determined by the plan you purchase and any accompanying order form, proposal, or onboarding documentation.
3. Eligibility & Business Use
The Services are intended for business use by persons at least 18 years of age with authority to bind the business they represent. By purchasing Services, you represent that you meet these requirements.
4. Fees, Billing & Cancellation
- Subscription billing. Services are billed monthly in advance at the rate stated at the time of purchase, plus any one-time setup fee stated at the time of purchase (for example, the Local Dominator program includes a one-time $499 setup fee). Recurring charges renew automatically each billing cycle until cancelled. Setup fees are non-refundable once onboarding work has commenced.
- Month-to-month. Unless otherwise stated in a signed order form, Services are provided month-to-month with no long-term commitment.
- Cancellation. You may cancel at any time by written notice to info@localleverage.ai. Cancellation takes effect at the end of the current billing cycle. Fees already paid are non-refundable except where expressly stated otherwise.
- Third-party costs. Advertising spend (e.g., Meta ad budgets), domain registration, and other third-party platform costs are separate from our fees unless expressly included in your plan.
- Late or failed payments. We may suspend Services if payment fails and is not cured promptly after notice.
5. Performance Guarantee (Local Dominator)
Where a ranking guarantee is offered for the Local Dominator program, the guarantee is as follows: if your business does not rank within the top five (5) local results within a three (3) mile radius of your business location within six to nine (6–9) months of work commencing, we will continue performing the ranking Services at no additional charge until that ranking is achieved. This guarantee is conditioned on: (a) your account remaining active and in good standing during the ranking period; (b) timely provision of access, approvals, and information we reasonably request; (c) no material changes to your business name, address, phone number, or Google Business Profile made without our coordination; and (d) compliance with these Terms. The guarantee covers continued service, not monetary refunds, and does not apply to suspensions or penalties imposed by third-party platforms outside our control.
6. Client Responsibilities
- Provide accurate business information and timely access to accounts, assets, and approvals reasonably required to deliver the Services.
- Maintain any licenses, insurance, or registrations required to lawfully operate and advertise your business.
- Review advertising content and communications for accuracy regarding your own claims, pricing, and offers.
- Use the Services only for lawful purposes and in compliance with applicable advertising, consumer protection, and communications laws.
7. AI Communication Tools; Call & Chat Recording
The Services and the Site include AI-powered chat and voice tools that may engage with you and your customers, qualify inquiries, and book appointments. Voice and chat interactions with our AI tools may be recorded, transcribed, and stored for quality assurance, service delivery, and training of our workflows. By interacting with these tools, you consent to such recording where permitted by law. If you deploy our AI tools in your own business, you are responsible for providing any notices and obtaining any consents required by the laws applicable to your business and your customers.
8. SMS & Communications Consent
By submitting your phone number through the Site or our forms, you consent to receive calls, text messages, and voicemail from or on behalf of Local Leverage AI regarding your inquiry and our Services, including messages sent using automated technology and AI-assisted tools. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out of texts at any time, or HELP for help. Your SMS opt-in consent will not be shared with or sold to third parties for their own marketing purposes.
9. No Guarantee of Specific Business Results
Except for the express ranking guarantee described in Section 5, we do not guarantee any specific volume of leads, calls, appointments, revenue, or other business outcomes. Marketing performance depends on factors outside our control, including your market, competition, pricing, sales practices, seasonality, and third-party platform behavior. Any examples of past performance shown on the Site are illustrations of what the systems have produced in specific circumstances and are not promises of your results.
10. Intellectual Property
We retain all rights in our methodologies, systems, software configurations, templates, and know-how. Upon payment in full, you receive ownership of final creative deliverables produced specifically for your business (such as ad creatives and website content), excluding our underlying tools and third-party components, which remain licensed. You grant us a limited license to use your name, logo, and brand assets to deliver the Services, and — unless you opt out in writing — to identify you as a client.
11. Third-Party Platforms
The Services depend on third-party platforms (including Meta, Google, and our software infrastructure providers). We are not responsible for outages, policy changes, account reviews, or suspensions imposed by those platforms, and their terms govern your use of their services.
12. Limitation of Liability
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data; and (b) our total aggregate liability arising out of or relating to the Site or Services shall not exceed the amounts you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Local Leverage AI and its owners, employees, and contractors from claims arising out of your business operations, the accuracy of claims about your own products or services, your use of the Services in violation of law or these Terms, or content and information you provide to us.
14. Termination
We may suspend or terminate Services for non-payment, breach of these Terms, unlawful use, or conduct that creates risk or legal exposure for us. You may terminate as described in Section 4. Sections that by their nature should survive termination (including Sections 9–13) survive.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The parties will first attempt in good faith to resolve any dispute informally. Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Broward County, Florida, and the parties consent to personal jurisdiction and venue there.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
